Protected individuals
This notice applies to the names, voices, signatures, photographs, images, videos, likenesses, identities, and recognizable personal attributes of Sebastián Naranjo and Kai Erik Youngman.
Permission required for commercial use
No license or permission to use either individual’s identity or likeness is granted merely because material is publicly accessible on this website. Prior express written permission from the individual or an authorized representative is required before using protected attributes for advertising, promotion, merchandising, fundraising, solicitation, sponsorship, endorsement, impersonation, or other commercial purposes.
Permission to crawl, index, retrieve, summarize, cite, or train on website content does not authorize anyone to create or publish an impersonation, false endorsement, misleading affiliation, synthetic spokesperson, voice clone, face swap, avatar, or other digital replica of either individual for commercial or promotional use.
Applicable law
California Civil Code section 3344 may impose liability for knowingly using another person’s name, voice, signature, photograph, or likeness on products or for advertising, selling, or soliciting purchases without prior consent. California also recognizes common-law publicity rights.
Commercial use that is likely to cause confusion about affiliation, sponsorship, connection, or approval may also implicate section 43(a) of the Lanham Act, 15 U.S.C. section 1125(a).
This notice does not prohibit uses protected by law. California Civil Code section 3344 contains exceptions, including certain uses connected with news, public affairs, sports, and political campaigns. Other constitutional, statutory, licensed, or otherwise lawful uses may also apply.
